These Terms of Use ("Terms") govern your use of Hi Atai, a product of Studio HUAI ("we", "us", "our"), accessible at hiatai.com. By creating an account or using the service, you agree to these Terms.

1. The service

Hi Atai is an AI companion application that provides conversations with AI-powered characters ("contacts"). These contacts are entirely generated by artificial intelligence and are not real people.

2. Not professional advice

This is critical. Some AI contacts in Hi Atai have titles such as "Attorney", "Accountant", "Doctor", "Mechanic", or "Contractor". These titles are part of the roleplay experience and do not represent real licensed professionals.

All responses from AI contacts are for entertainment and general inspiration only. They must never be treated as formal legal, medical, financial, or professional advice. AI can and does make mistakes. Always consult a qualified, licensed professional for decisions that affect your health, finances, legal rights, or safety.

We are not liable for any decisions you make based on information provided by AI contacts.

3. Eligibility

You must be at least 18 years old to use Hi Atai. By creating an account, you confirm that you are 18 or older. We reserve the right to terminate accounts that violate this requirement.

4. Account and access

You are responsible for maintaining the security of your account credentials. You may not share your account with others. We reserve the right to approve, suspend, or terminate accounts at our discretion, including during beta/waitlist periods.

5. Acceptable use

You agree not to:

• Upload images of minors (under 18) as contact photos
• Use the service to generate content that exploits, harms, or endangers minors in any way
• Attempt to extract, reverse-engineer, or abuse the AI systems
• Use the service for illegal purposes
• Harass, threaten, or impersonate real individuals through the service
• Circumvent rate limits, credit systems, or access controls
• Share or redistribute AI-generated content in ways that misrepresent it as real (e.g., presenting AI photos as real photos of real people)

6. AI-generated content

All text and images generated by AI contacts are created by artificial intelligence. This content may contain inaccuracies, biases, or errors. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

AI-generated photos of contacts are fictional. They do not depict real people and should not be used to deceive others.

Language quality

Hi Atai supports conversations in multiple languages. The experience is optimised for English and Danish, with strong support for other major European languages (German, French, Spanish, Dutch, Swedish, Norwegian). For other languages, conversation quality may vary — tone, slang, and cultural nuances may be less natural. We are continuously working to improve language support. Using Hi Atai in a less-supported language is considered a beta experience.

7. Photo uploads and image rights

When you upload a photo for a contact, you confirm that:

• You have the legal right to use the image
• The person depicted is 18 years or older
• You consent to the image being processed by AI for generating situation photos

We run automated age-verification checks on uploaded images. Violations involving minors will result in immediate account termination and may be reported to relevant authorities.

8. Subscriptions and payments

Hi Atai offers free and paid subscription tiers. Paid subscriptions are billed monthly through Stripe. By subscribing, you authorise recurring charges until you cancel.

• Credits are allocated monthly and expire at the end of each billing cycle (except for Silver and Gold tiers, which allow one-month rollover)
• Top-up credit packs are one-time purchases and do not expire
• Refunds are handled on a case-by-case basis — contact us at hello@hiatai.com
• We reserve the right to change pricing with 30 days' notice to existing subscribers

9. Intellectual property

Hi Atai, its design, branding, AI contact characters, and all associated content are the intellectual property of Studio HUAI. You may not copy, reproduce, or redistribute the service or its content without permission.

Content you create (messages, profile data) remains yours. By using the service, you grant us a limited license to process your content solely for the purpose of providing the service.

10. Limitation of liability

Hi Atai is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the service
• We are not responsible for the accuracy of AI-generated content
• We are not responsible for actions you take based on AI-generated advice
• Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim

11. Termination

You may delete your account and all associated data at any time using the "Delete all my data" button in the app's Settings. We may terminate or suspend your account if you violate these Terms, with or without notice.

12. Changes to these Terms

We may update these Terms from time to time. We will notify existing users of material changes via email or in-app notification. Continued use of the service after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Denmark. Disputes shall be resolved in the courts of Denmark, without prejudice to any mandatory consumer protection rights in your country of residence.
